1. Information for users

Who is responsible for processing your personal data?

AGRAR PLANTAS DEL SUR, S.A. is the DATA CONTROLLER responsible for processing the USER’s personal data and informs you that these data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data and for what purposes?

Depending on the form through which we have obtained your personal data, we will process them confidentially for the following purposes:

In the Contact

• To respond to enquiries or any type of request submitted by the user through any of the contact methods made available on the Data Controller’s website.

• To send advertising and commercial communications by e-mail, fax, SMS, MMS, social media or any other present or future electronic or physical means that enables commercial communications. These communications will be sent by the Data Controller and will relate to its products and services, or those of its partners or suppliers with whom it has entered into a promotional agreement. In this case, third parties will never have access to personal data.

How long will we retain your personal data?

They will be retained for no longer than necessary to fulfil the purpose of the processing or for as long as legal requirements require their retention. When they are no longer required, they will be deleted using appropriate security measures to ensure the anonymisation or complete destruction of the data.

Who do we disclose your personal data to?

No disclosure of personal data to third parties is envisaged, except where necessary for the development and performance of the purposes of the processing, to our communications-related service providers, with whom the DATA CONTROLLER has entered into the confidentiality and data-processing agreements required under current privacy regulations.

What are your rights?

The USER has the following rights:

• The right to withdraw consent at any time.
• The right of access, rectification, portability and erasure of your data, and the right to restrict or object to its processing.
• The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with current regulations.

2. Mandatory or optional nature of the information provided by the user

By ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) on the contact form or included in download forms, USERS expressly, freely and unequivocally accept that their data are necessary for the service provider to respond to their request, while providing data in the remaining fields is optional. The USER guarantees that the personal data supplied to the DATA CONTROLLER are accurate and undertakes to communicate any changes to them.

The DATA CONTROLLER informs users that all data requested through the website are mandatory, as they are necessary to provide the USER with an optimal service. If all requested data are not provided, it cannot be guaranteed that the information and services supplied will fully meet the user’s needs.

3. Security measures

In accordance with current personal data protection regulations, the DATA CONTROLLER complies with all provisions of the GDPR and LOPDGDD applicable to the processing of personal data for which it is responsible, and in particular with the principles set out in Article 5 of the GDPR, under which personal data are processed lawfully, fairly and transparently in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The DATA CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has provided them with appropriate information so that they may exercise those rights.
